Court declares speed limit ordinance of Tupi invalid

In a decision on Tuesday, February 2, 2016 Regional Trial Court Branch 39 in Polomolok, South Cotabato declared Ordinance No. 688 of the Municipality of Tupi as invalid.

The said ordinance which sets the speed limit in Tupi at 80 kilometers per hour (kph) along the national highway and 40 kph within the town proper or Poblacion area passed by the Sanggunian Bayan (SB) in April 2014 was intended to reduce, if not eliminate, road accidents due to reckless driving and overspeeding.

The decision of the court also prohibits LGU-Tupi in enforcing and implementing the said ordinance and orders that collected fines from apprehended vehicle owners and drivers must be returned.

Aside from Tupi, other municipalities in South Cotabato that has a speed limit ordinance are Polomolok and Tboli.
